1. Who We Are
Forest TMS is operated by Forest TMS Ltd, a company registered in the United Kingdom.
Forest TMS provides cloud-based tools for reservations, CRM, analytics, and restaurant operations.
2. Definitions
“Platform” – Forest TMS software, dashboard, modules, APIs, and related services.
“User” – Anyone accessing the website or platform.
“Client” – Restaurants or businesses with an account on Forest TMS.

“Guest Data” – Customer data processed on behalf of restaurant clients.
3. Use of Our Platform
To use Forest TMS, you must:
Be at least 18
Provide accurate account and billing information
Keep login credentials secure
Use the platform only for lawful business purposes
You agree not to:
Reverse-engineer or copy the platform
Interfere with system security or performance
Misuse API endpoints or exceed reasonable usage
Use the service to send spam or unlawful communications
We may suspend access if the platform is used improperly.
4. Subscriptions & Payments
Forest TMS operates on a subscription model. By subscribing:
You agree to pay the fees outlined in your service plan or agreement
Fees are billed monthly or annually
Billing is handled securely via third-party processors such as Stripe
Prices may change; we will notify you in advance
If payment fails, we may restrict or suspend access until resolved.
5. Free Trials
If a free trial is offered:
Its duration is stated at signup
Billing begins automatically after the trial unless cancelled before the end date
We reserve the right to modify or remove trial offers at any time.
6. Guest Data & Data Protection
When processing guest reservation data on behalf of clients, Forest TMS acts as a Data Processor.
Clients are responsible for:
Obtaining lawful consent from guests
Providing accurate data
Complying with UK GDPR and relevant data laws
We only process guest data according to client instructions.
For personal data we collect directly (e.g., user accounts), we act as a Data Controller as detailed in our Privacy Policy.
7. Integrations
Forest TMS may integrate with third-party platforms such as:
WhatsApp Business / Meta
POS systems
Marketing or booking platforms
We are not liable for downtime, failures, restrictions, or policy changes on third-party services.
You are responsible for maintaining valid accounts and permissions for any integrations you connect.
8. Availability & Maintenance
We aim to provide continuous access but do not guarantee uninterrupted or error-free service.
Forest TMS may:

Release updates
Introduce new features or retire old ones
Temporary interruptions may occur.
9. Intellectual Property
All content, branding, software, and materials provided through Forest TMS are owned by Forest TMS Ltd.
You may not:
Copy, distribute, or resell the platform
Modify or reverse-engineer the software
Use our branding without permission
You retain all rights to your data.
10. Termination
You may request cancellation of your subscription, but cancellation will only take effect after the notice period defined in your service agreement.
Access to the platform will continue until the end of the notice period, and all fees applicable during that period remain payable.
We may terminate or suspend accounts if:
Terms are violated
Payments are overdue
The platform is misused
You breach your service agreement
After termination, we may retain certain data as required by law or for legitimate business purposes (e.g., accounting, fraud prevention).
11. Limitation of Liability
As permitted by UK law:
We are not liable for lost profits, business interruption, data loss, or indirect damages

Our total liability is limited to the fees paid by you in the preceding 12 months
We do not guarantee that the platform will be error-free or meet every operational need.

You agree to indemnify Forest TMS against claims arising from:
Misuse of the platform
Violation of these Terms

Issues caused by integrations you connect

13. Changes to These Terms

Any disputes will be handled exclusively in the courts of England and Wales.
